1. Acceptance of Terms

By downloading, installing, or using the iTimer application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and iAppClub ("we," "our," or "us").

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and install the App on your personal Apple devices and use it for its intended purpose as a personal interval training timer.

This license does not include the right to:

• Modify, reverse-engineer, decompile, or disassemble the App.
• Distribute, sell, sublicense, or lease the App to third parties.
• Use the App for any commercial purpose without our written consent.
• Remove, alter, or obscure any proprietary notices in the App.

3. Description of the App

iTimer is a personal interval training timer application for iOS and watchOS. The App allows you to:

• Create and customize interval training workouts using built-in templates (Tabata, HIIT, Circuit, EMOM, Boxing, 7 Minute, Stretching) or fully custom formats
• Configure workout phases with customizable durations, names, colors, and icons
• Receive audio and haptic feedback during workouts
• Track workout history
• Sync data across your Apple devices via iCloud
• Use Live Activities and Dynamic Island on your Lock Screen
• Control workouts from your Apple Watch
• Localized in 15 languages with 704 voice coaching clips
• ADHD-focused distraction profiles to keep you focused
• Visual phase flash for silent workout transitions

4. Health & Fitness Disclaimer

IMPORTANT: PLEASE READ THIS SECTION CAREFULLY.

iTimer is a timer tool designed to help you structure interval training workouts. The App is NOT a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition. It does not provide medical advice, fitness advice, or health recommendations. It does not monitor, measure, or record health data from sensors or HealthKit. Any health-related data (heart rate, calories) displayed in the App is manually entered by you and is not verified or validated by the App.

Before beginning any exercise program, you should:

• Consult with a qualified healthcare professional or physician.
• Consider your personal health condition, fitness level, and any pre-existing medical conditions.
• Stop exercising immediately and seek medical attention if you experience chest pain, dizziness, fainting, shortness of breath, or any other unusual symptoms.

By using iTimer, you acknowledge and accept that physical exercise carries inherent risks of injury. You are solely responsible for determining the appropriateness of any workout for your fitness level, and you assume full responsibility for any injury, health issue, or damage resulting from your use of the App.

5. User Responsibilities

As a user of iTimer, you agree to:

• Use the App only for lawful purposes and in accordance with these Terms.
• Not misuse the App or attempt to gain unauthorized access to its systems.
• Keep your device and iCloud account secure.
• Accept responsibility for all activities that occur under your iCloud account.
• Comply with all applicable local, state, national, and international laws.

6. Intellectual Property

The App, including its code, design, text, graphics, icons, audio clips, and logos, is the intellectual property of iAppClub. You retain all rights to your user-generated content (timer presets, workout history, manually entered data).

7. iCloud & CloudKit Services

iTimer uses Apple's CloudKit framework to sync your data across devices. CloudKit services are provided by Apple Inc. and are subject to Apple's Terms of Service. Data synced via iCloud is stored in your personal iCloud account. We do not have access to, control over, or responsibility for your iCloud account or its data.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED USE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, iAppClub shall NOT be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, including personal injury, health complications, loss of data, or interruption of timer functionality. Our total liability shall not exceed the amount you paid for the App.

11. Indemnification

You agree to indemnify, defend, and hold harmless iAppClub from any claims, damages, losses, or expenses arising from your use of the App, violation of these Terms, or any health-related injury resulting from your exercise activities.

12. App Modifications

We reserve the right to update, modify, or discontinue the App or any feature at any time without notice. We are not obligated to provide any specific feature, update, or support.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will update the "Last Updated" date and provide notice of material changes. Your continued use after changes constitutes acceptance.

14. Termination

These Terms remain in effect until terminated. You may terminate by uninstalling the App. We may terminate by discontinuing the App. Upon termination, the license granted in Section 2 ceases immediately.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which iAppClub operates. Any disputes shall be resolved in the courts of the applicable jurisdiction.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and iAppClub regarding your use of the App.
